What to look for in a search warrant

A search warrant is a document issued by a judge that allows the police to search a specific place and seize certain items. In Indiana, police must show probable cause that evidence of a crime is likely to be found at the location. The warrant must be based on sworn facts rather than assumptions 

How do you know if a search warrant is valid? Here are some key things to look for.

What makes a search warrant valid

To be valid, a search warrant must meet clear legal requirements. These include:

  • A detailed description of the place to be searched

  • A list of the items officers are allowed to seize

  • A sworn statement explaining the probable cause

  • A judge’s signature and the date of issue

The warrant must be specific. It cannot allow a general search of a property without naming the location and items involved.

When a search warrant is invalid

A search warrant may be invalid if it lacks probable cause, contains false information or is overly broad. It may also be invalid if it is signed by someone without authority or if officers search outside the scope of the warrant. For example, if the warrant is for a garage but police search a bedroom, the search may not be lawful.

If a search warrant is found to be invalid, the evidence collected during that search may not be used in court. This is called suppression of evidence. Indiana courts follow the exclusionary rule, which means that unlawfully obtained evidence is generally not allowed in criminal trials.
