Can you expunge felony and misdemeanor convictions together?

On Behalf of | Oct 19, 2026 | Expungement

Indiana law may let you seek expungement for more than one conviction at the same time. In many cases, you must include all eligible convictions from the same county in one petition. If the convictions are in different counties, you usually file in each county.

Can felonies and misdemeanors be combined?

Yes, sometimes. A person may be able to include both felony and misdemeanor convictions if each one meets Indiana’s expungement rules. The key issue is not just the number of convictions. Each conviction must be eligible on its own.

Do waiting periods apply?

Yes. Different convictions have different waiting periods. Some misdemeanor convictions may qualify after five years. Some felony convictions may need a longer wait, depending on the offense and sentence.
Other rules may also apply. You may need to finish probation or other sentence terms, pay required fees and avoid new convictions during the waiting period.

What if the convictions are in different counties?

If your convictions come from different counties, you usually cannot combine them in one filing. You may need to file separate petitions in each county where a conviction was entered.

Why careful review matters

Indiana expungement rules include specific details, and not every conviction qualifies. State law excludes some offenses and filing rules limit how often you can seek expungement.
Before filing, review your full criminal record so you do not leave out an eligible conviction or miss a filing rule. An Indiana attorney can help you see which convictions may qualify and when you can file.
